San Jose Sharks “Ultimate Game Night Experience” Sweepstakes 2008/09

ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. San Jose Sharks “Ultimate Game Night Experience” Sweepstakes (the "Sweepstakes") is open to legal residents of California, who are eighteen (18) years or older at the time of entry. Employees, officers, and directors (including immediate family members or members of the same household) of San Jose Sharks, LLC (the "Sponsor"), and each of its affiliated companies, licensees, distributors, retailers, advertising and promotion agencies, and all other companies associated with the Sweepstakes are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.

HOW TO ENTER: The Sweepstakes begin on Tuesday, April 8, 2008 at 10:00 a.m. PT and ends Sunday, June 15, 2008 at 11:59 p.m. PT (the "Entry Period"). There are only two (2) methods to enter: online or by mail. No other method of entry will be accepted. Limit one (1) entry per person, family or household regardless of method of entry. All entries become the property of the Sponsor and will not be returned.

1. Online Method: During the Entry Period, visit sjsharks.com.com and click on the link to launch the online entry form for the Sweepstakes. By submitting your complete name (first and last name), date of birth, address, city, state, ZIP/postal code, contact telephone number, and e-mail address to the San Jose Sharks via the online entry form, you will be automatically entered in the Sweepstakes. All information submitted by entrants is subject to San Jose Sharks Privacy Statement accessible at: http://www.sjsharks.com/team/PrivacyStatement.asp

All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address. Entrants must complete all non-optional data requested on the online entry form. Incomplete entries are void and will not be accepted. All online entries must be received by Sponsor not later than 11:59 p.m. PT on Sunday, June 15, 2008.

2. Mail-in Method: If you do not wish to enter online, you may enter the Sweepstakes by printing your first and last name, address, city, state and zip code, date of birth, day and evening telephone number and email address (optional) on a standard size postcard and mail to: "San Jose Sharks Ultimate Game Night Experience Sweepstakes," San Jose Sharks Hockey Club, 525 W. Santa Clara Street, San Jose, CA 95113. The Sponsor will use phone number provided via the Mail-in entry method for Prize notification purposes only. Mail-in entries must be postmarked by Friday, June 13, 2008, and received by the Sponsor no later than Saturday, June 14, 2008. Mail-in entries received after 5:00 p.m. PT on Saturday, June 14, 2008, will not be eligible to be included in the Sweepstakes.

RANDOM DRAWING: The winner of the Sweepstakes ("Winner") will be selected by random drawing on or about Friday, June 20, 2008, from all eligible entries received by the Sponsor, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. All prizes will be awarded. Limit one (1) prize per person, family or household.

PRIZE: Grand Prize: There shall be one (1) Grand Prize Winner. The Grand Prize Winner shall receive (4) lower bowl seats, (1) team autographed authentic San Jose Sharks jersey, dinner in the press room for (4) people, the opportunity to watch warm-ups from penalty box and a Zamboni ride for (1) guest at an agreed upon home game during the 2008/09 regular season. The Grand Prize (“Prize”) Winner shall be referred to as the “Winner.” The Winner shall be fully responsible for any and all applicable federal, state, international and local taxes. All costs and expenses not specified herein, related to the Prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the Prize are the sole responsibility of Winner. NHL game dates, or the rescheduling of the designated game, and times are determined in the sole discretion of the Sponsor, as applicable, and may be subject to change. The terms and conditions of the tickets to the Suite awarded as the Prize will govern in the event a legal game, as defined by the National Hockey League, is not played due to weather, an Act of God, an act of terrorism, civil disturbance or any other reason. The Prize is non-transferable and non-assignable, with no cash redemption or substitution except at the Sponsor's sole discretion. The Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of the selected game.

NOTIFICATION: The Winner will be notified by e-mail and/or telephone by the Sponsor, or in the event a Winner entered by regular mail, he or she will be notified by telephone and/or overnight mail by the Sponsor. In the event that the Winner does not respond to any such notification within three (3) days, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. The Winner will receive the Sponsor's Affidavit of Eligibility and Release of Liability, which must be completed, notarized and returned within seven (7) days of Winner’s receipt. A disqualification will result and an alternative winner will be randomly selected from among all remaining eligible entries if the Sponsor's Affidavit of Eligibility and Release of Liability is not properly returned to Sponsor within the specified period of time. Refusal or return of the Sponsor's Affidavit of Eligibility and Release of Liability as non-deliverable will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.

WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering the Sweepstakes, the Winner agrees to waive any and all claims against San Jose Sharks, LLC, City of San Jose, and their respective agents and representatives for any injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any Prize or travel related to the receipt or use of any Prize, and the Winner grants to the Sponsor the right to publicize such Winner's name and/or likeness in any medium without additional compensation or consideration unless prohibited by law.

GENERAL CONDITIONS: The Sponsor and their agents and representatives are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Sponsor and its respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or Prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, the Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select a Winner from all eligible entries received prior to the act that compromised the promotion. In the event of cancellation, the Sponsor may elect to identify the Winner and award the Prize by way of random drawing from among all entrants who had entered the Sweepstakes at the time of such cancellations.

Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor. The Sponsor shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. The Sponsor (i) makes no warranty, guaranty or representation of any kind concerning the Prize, and (ii) disclaims any implied warranty. As a condition of entering the Sweepstakes, each entrant agrees that: (1) under no circumstances will the entrant be entitled or permitted to obtain awards for, and entrant expressly waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased; (2) any and all disputes, claims, causes of action, and liability arising out of or connected in any way with this Sweepstakes and/or the Prize shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the rules of the American Arbitration Association; and (3) in no event shall attorney's fees be recoverable by either party. All disputes will be resolved under applicable U.S. laws in Santa Clara County, State of California.

By participating in the Sweepstakes, each entrant agrees, to the fullest extent permitted by law, to indemnify, release, forever discharge, and hold harmless, and covenants not to sue, San Jose Sharks, LLC, Silicon Valley Sports & Entertainment LLC, San Jose Arena Management LLC, HP Pavilion at San Jose, City of San Jose, and each of their respective owners, members, directors, officers, employees, agents, representatives, successors, heirs, and assigns, and each and every person acting by, through, under or in concert with them, or any of them (hereinafter individually and collectively referred to as the "Indemnified Parties"), of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, damages, liability, loss cost or expense, of any nature whatsoever, known or unknown, fixed or contingent which the entrant may have or hereafter have against the Indemnified Parties by reason of any damages, loss, or injuries sustained by the entrant, whether to his/her person and/or property, as a result of or incident to the acts or omissions of the Indemnified Parties in conducting the Sweepstakes and/or of participating in the Sweepstakes.

Online entrants to the Sweepstakes will be given the option to receive commercial e-mails from sjsharks.com; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such e-mails.

Santa Clara Street, San Jose, CA 95113. Winner's list requests must be received by Sponsor by Friday, June 20, 2008.
