OFFICIAL RULES
ELIGIBILITY: NO
PURCHASE OR SUBMISSION OF SURVEY NECESSARY TO ENTER OR WIN. A
PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Washington Nationals Suite
and Seat Stakes Sweepstakes (the “Sweepstakes”) is open to legal residents of
the District of Columbia, Virginia, West Virginia, Maryland and Pennsylvania,
who are eighteen (18) years or older at the time of entry (except in the case
of legal residents of certain states or the District of Columbia where the age
of majority is greater than eighteen (18) years of age, such age of majority). Employees,
officers, and directors (including immediate family members (spouse, parent,
child and sibling and their respective spouses, regardless of where they
reside) and members of the same household, whether or not related) of
Washington Nationals Baseball Club (the “Sponsor”), the other MLB Entities and
each of their respective parents, affiliated companies, subsidiaries,
licensees, distributors, dealers, retailers, printers and advertising and
promotion agencies, and any and all other companies associated with the
Sweepstakes are not eligible to participate or win a prize. The “MLB Entities” shall mean the Office of
the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and
Councils, MLB Advanced Media, L.P. (“MLBAM” or “MLB.com”), SportsOnEarth, LLC,
Tickets.com, Inc., Major League Baseball Enterprises, Inc., Major League
Baseball Properties, Inc., the Major League Baseball Clubs, and each of their
subsidiaries or affiliated entities, any entity which, now or in the future,
controls, is controlled by, or is under common control with the Major League
Baseball Clubs or the Office of the Commissioner of Baseball, and the
directors, officers, employees and agents of the above entities. The Sweepstakes
is subject to all applicable federal, state, local laws and regulations. Void outside the states listed above and
where prohibited or restricted by law, rule or regulation.
HOW TO ENTER: The Sweepstakes
begins at 8:00 a.m. Eastern Time (“ET”) on July 20, 2008 and ends at 10:00 p.m.
ET on September 12, 2008 (“Entry Period”).
There are two (2) ways to enter: online, or by mail. No other method of entry will be accepted.
Limit one (1) entry per person/e-mail address/household, regardless of method
of entry.
1. Online Method: During the Entry Period, go to
nationals.com and click on the Sweepstakes banners, buttons and/or links to
access an online survey. By submitting your completed survey as directed,
participants will be automatically entered in the Sweepstakes. All information
submitted online by entrants is subject to MLB.com's Website terms of use
accessible at: http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp
and Privacy Policy accessible at: www.mlb.com/privacy. Entrants must fully
complete and submit all non-optional data requested on the online entry form to
be eligible. Incomplete entries are void. Online entrants to the Sweepstakes may
be given the option to receive (a) commercial e-mails from nationals.com and/or
mlb.com and/or (b) mobile text messages and updates from MLB; however,
eligibility to participate in the Sweepstakes is not dependent upon entrant's
consent to receive such e-mails or mobile text messages and updates. Standard
messaging rates apply to mobile text messages and updates. Check with your
mobile service provider for more information.
2. Mail-in Method: If you would like to enter the Sweepstakes without having to submit a
survey, you may enter the Sweepstakes by hand-printing your name, address,
city, state and zip code, day & evening telephone number (including area
code), date of birth and e-mail address (optional) on a standard size postcard
and mailing it in an envelope with proper postage affixed to: Washington Nationals Baseball Club, c/o Marketing
Department, 1500 South Capitol Street SE, Washington DC 20003-1507. Sponsor
will use e-mail addresses provided via the Mail-in entry method for prize
notification purposes only; however, eligibility to participate in the
Sweepstakes is not dependent upon entrant’s provision of this information. Mail-in entries must be postmarked by September
12, 2008 and received by Sponsor by September 17, 2008 to be eligible. Mail-in entries become the property of the Sponsor and will not be
returned.
RANDOM DRAWING: The potential
winners of the Sweepstakes (each a “Winner” and collectively, the “Winners”)
will be selected by random drawing on or about September
17, 2008 from among all eligible entries received by the
Sponsor
or MLBAM, as applicable. The decisions
of Sponsor are final and binding on all matters relating to this
Sweepstakes. Odds of winning depend on the total number of
eligible entries received. All prizes
will be awarded. Limit one (1) Prize per
person, family or household.
PRIZES: Four
(4) Prizes Will Be Awarded.
First Prize: One (1) Winner will receive: use of one (1) Party
Suite (including game tickets) for one (1) 2008 Washington Nationals regular
season game (collectively, the “First Prize”) (estimated retail value (“ERV”)
of First Prize: $3,200).
Second
Prize: One (1) Winner will receive four
(4) Presidents Seats for one (1) 2008 Washington Nationals regular season game (the
“Second Prize”) (ERV of Second Prize: $1,300).
Third
Prize: One (1) Winner will receive four
(4) Diamond Seats for one (1) 2008 Washington Nationals regular season game (the
“Third Prize”) (ERV: $510.00).
Fourth
Prize: One (1) Winner will receive four
(4) Center Field Lounge Seats for one (1) 2008 Washington Nationals regular
season home game (the “Fourth Prize”) (ERV of Fourth Prize: $240.00).
TRANSPORTATION
TO/FROM THE GAME NOT INCLUDED WITH ANY PRIZE. Exact game(s) and seat locations at
such games shall be determined by the Washington Nationals in its sole and
absolute discretion.
Each
Winner is fully responsible for any and all applicable federal, state and local
taxes (including income and withholding taxes).
All costs and expenses associated with Prize acceptance and use not
specified herein as being provided, including but not limited to lodging,
transportation costs, meals, gratuities and
other expenses incurred by accepting the Prize are the sole responsibility of the
Winners. Winners’ companions must be of
legal age of majority in their jurisdictions of residence, unless accompanied
by a parent or guardian. Major League
Baseball game, event and exhibition dates and times are determined in the sole
discretion of the Office of the Commissioner of Baseball and/or the Washington
Nationals, as applicable, and may be subject to change. The terms and conditions of the tickets
awarded as prizes will govern in the event a legal game, event or exhibition,
as defined by Major League Baseball, is not played due to weather, an act of
God, an act of terrorism, civil disturbance or any other reason. Each Winner and his/her guest(s) agree to
comply with all applicable stadium regulations in connection with the
Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to
deny entry to Winners and/or his/her guest(s) who engage(s) in a
non-sportsmanlike or disruptive manner, or with intent to annoy, abuse,
threaten or harass any other person at the game, event or exhibition. The Released Parties (defined below)
will not be responsible for Acts of God, acts
of terrorism, civil disturbances, work stoppage or any other natural disaster
outside their control that may cause the cancellation or postponement of any
Major League Baseball game, event or exhibition.
The
Prize is non-transferable and non-assignable, with no cash redemptions except
at Sponsor’s sole and absolute discretion.
Sponsor reserves the right to substitute a prize (or portion thereof)
with one of comparable or greater value at its sole and absolute discretion.
NOTIFICATION: Each potential Winner will be
notified by e-mail and/or telephone by the Sponsor and/or MLBAM and may (in
Sponsor's discretion) be confirmed by postal mail, return receipt (the
"Prize Notification"). In the
event that the potential Winner does not respond to such Prize Notification
within three (3) days of date of notification, a disqualification will result
and prize will be forfeited, at Sponsor’s sole discretion and time permitting, an
alternate potential Winner shall be chosen from among all remaining eligible
entries. Each potential winner may be
required to submit his/her valid social security number and/or other
identification to Sponsor and will be required to execute and return an
Affidavit of Eligibility and Release of Liability and, unless prohibited by
law, Publicity, within five (5) days of date of receipt. A disqualification will result and an
alternate potential Winner will be randomly selected from among all remaining
eligible entries if all required documents are not properly executed and
returned within the specified period of time.
Refusal or return of such documents as non-deliverable or potential
Winner’s noncompliance with these Official Rules will also result in
disqualification and cause an alternate Winner to be chosen from among all
remaining eligible entries.
WAIVER
OF LIABILITY/PUBLICITY RELEASE: By
participating in the Sweepstakes and submitting an entry, each entrant agrees
to (i) be bound by these Official Rules, including all entry requirements, and
(ii) waive any and all claims against the Sponsor, the other MLB Entities and
each of their respective parents, affiliated companies, subsidiaries, officers,
directors, employees, agents, licensees, distributors, dealers, retailers,
printers, representatives and advertising and promotion agencies, and any and
all other companies associated with the Sweepstakes, and all of their
respective officers, directors, employees, agents and representatives
(collectively, “Released Parties”) for any injury, damage or loss that may
occur, directly or indirectly, in whole or in part, from the participation in
the Sweepstakes or from the receipt or use of any Prize or any travel or activity related to the receipt or use of
any Prize. By acceptance of Prize, each
Winner grants to Sponsor, the other MLB Entities and their respective designees
the right to publicize such Winner’s name, address (city and state of
residence) ), photograph, voice and/or other
likeness and prize information in any media now known or hereafter devised,
throughout the world, in perpetuity, without limitation and without additional
compensation or consideration, notification or permission, unless prohibited by
law.
GENERAL CONDITIONS: Released Parties
are not responsible for printing or typographical errors in any
Sweepstakes-related materials; stolen, late, misdirected, lost, damaged,
garbled, delayed, incomplete, inaccurate, postage due or illegible entries or
mail. Sweepstakes entries generated by a
script, macro or other mechanical or automated means will be disqualified. The Released Parties are not responsible for
incorrect, inaccurate transcription or loss or delay of entry or prize reply
information, or any viruses transmitted to computers of participants via the
Internet, or for any technical or human errors associated with the
Sweepstakes. If, in the exclusive
judgment of MLBAM or Sponsor, this promotion becomes compromised in any way,
MLBAM and Sponsor reserve the right to withdraw the promotion offer, cancel any
method of entry, to void any entries submitted fraudulently or select winners
from all eligible entries received prior to act that compromised the promotion.
Released
Parties are not responsible for injury or damage to participants' or to any
other person's computer related to or resulting from participating in this
Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect
of the Sweepstakes or website or attempt to undermine the legitimate operation
of the Sweepstakes by cheating, deception or other unfair playing practices, or
intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s
representatives or who are in violation of these Official Rules, as solely
determined by Sponsor, will be disqualified and all associated entries will be
void. Any attempt to deliberately damage
the content or operation of this Sweepstakes is unlawful and subject to legal
action by the Sponsor, MLBAM or their respective agents. Sponsor shall have the sole right to
disqualify any entrant for violation of these Official Rules or any applicable
laws relating to the Sweepstakes, and to resolve all disputes in their sole
discretion. Released Parties (i) make no
warranty, guaranty or representation of any kind concerning any Prize, and (ii)
disclaim any implied warranty. All
disputes will be resolved under applicable
Sponsor and MLBAM reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify Winners and award the Prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
CAUTION: ANY
ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE
CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL
AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND MLBAM WILL
DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING
ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT
PERMITTED BY LAW.
All
online entries must include a valid e-mail address for the entrant. In case of multiple entries received from any
person or email address or household, only the first entry received from such
person or email address or household will be considered. In the event of dispute as to the identity or
eligibility of any Winner based on an e-mail address, the winning entry will be
declared made by the “Authorized Account Holder” of the e-mail address
submitted at the time of entry provided he/she is eligible according to these
Official Rules. The “Authorized Account
Holder” is defined as the natural person to whom the applicable Internet
service provider or other organization (such as a business or educational
institution) has assigned the e-mail address for the domain associated with the
submitted e-mail address.
WINNERS’ LIST: For a list of Winners (available after
October 1, 2008), mail a self-addressed stamped envelope to: Washington
Nationals Baseball Club, c/0 Marketing Department, 1500 South Capitol Street
SE, Washington DC 20003-1507. Winner’s
list requests must be received by October 31, 2008.
